Part 1 — Website Use
These terms and conditions apply between you, the User of this Website (including any sub-domains, unless expressly excluded by their own terms and conditions), and Bartha Contemporary Ltd., the owner and operator of this Website. Please read these terms and conditions carefully, as they affect your legal rights. Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the Website.
You must be at least 18 years of age to use this Website.
1. Intellectual property and acceptable use
All Content included on the Website, unless uploaded by Users, is the property of Bartha Contemporary Ltd., our affiliates or other relevant third parties. Content is protected by copyright, trademarks, database rights and other intellectual property rights. You may, for your own personal, non-commercial use only, retrieve, display and view the Content on a computer screen. You must not otherwise reproduce, modify, copy, distribute or use for commercial purposes any Content without the written permission of Bartha Contemporary Ltd.
2. Prohibited use
You may not use the Website in any way which causes, or may cause, damage to the Website or interferes with any other person's use or enjoyment of the Website; in any way which is harmful, unlawful, illegal, abusive, harassing, threatening or otherwise objectionable; or to make, transmit or store electronic copies of Content protected by copyright without the permission of the owner.
3. Registration and client accounts
You must ensure that the details provided by you on registration or at any time are correct and complete. You must inform us immediately of any changes to your information. We may suspend or cancel your registration with immediate effect for any reasonable purposes or if you breach these terms and conditions. Client accounts are personal to you and may not be shared or transferred. You are responsible for maintaining the confidentiality of your login credentials.
4. Links to other websites
This Website may contain links to other sites. Unless expressly stated, these sites are not under the control of Bartha Contemporary Ltd. We assume no responsibility for the content of such websites and disclaim liability for any loss or damage arising out of their use.
5. Privacy Policy

6. Limitation of liability
Nothing in these terms and conditions will limit or exclude liability for death or personal injury resulting from negligence, or for fraud or fraudulent misrepresentation. To the maximum extent permitted by law, Bartha Contemporary Ltd. accepts no liability for business losses, loss or corruption of data, or any special, indirect or consequential loss or damage. This Agreement shall be governed by and interpreted according to the law of England and Wales.
Part 2 — Sale of Goods and Purchase Terms
The following terms apply to all purchases made through this Website, whether by card payment, bank transfer, or following acceptance of an offer. These terms form part of the contract between you and Bartha Contemporary Ltd. for the purchase of artworks.
7. Contract formation
No contract for the sale of an artwork is formed until Bartha Contemporary Ltd. has received cleared funds in full. The placing of an order, clicking "Buy now", requesting an invoice, or submitting an offer does not in itself constitute a binding contract. For card payments, the contract is formed on completion of the Stripe payment process. For bank transfer payments, the contract is formed when cleared funds are received in our account. The gallery reserves the right to cancel any order prior to receipt of cleared funds, for example if an artwork has been simultaneously sold through another channel, and will promptly refund any payment made.
8. Offers
Submitting an offer through the Website creates no obligation on Bartha Contemporary Ltd. to accept that offer or to sell the artwork at the offered price or at all. All offers are subject to gallery review and will be responded to by email. An offer is accepted only when Bartha Contemporary Ltd. expressly confirms acceptance in writing. Following acceptance, payment is due within 14 days unless otherwise agreed in writing. Bartha Contemporary Ltd. reserves the right to decline any offer without giving reasons.
9. Pricing and currency
All prices displayed on the Website are in Pounds Sterling (GBP) unless otherwise stated. Prices are correct at the time of display but may be subject to change without notice. Bartha Contemporary Ltd. reserves the right to cancel a purchase if a pricing error has occurred, in which case any payment will be refunded in full.
10. VAT and taxation
Artworks sold to buyers in the United Kingdom are sold under the VAT Margin Scheme. Under this scheme, VAT is accounted for on the gallery's margin rather than the full sale price, and no VAT is separately itemised on the invoice. The price displayed is the total price payable. Artworks sold to buyers outside the United Kingdom are supplied VAT-exempt (zero-rated for export purposes). International buyers are solely responsible for all import duties, customs charges, taxes, and any other levies applicable in their country or territory of destination. Bartha Contemporary Ltd. is not responsible for estimating or paying any such charges and makes no representations as to their amount.
11. Payment methods
We accept payment by credit or debit card (processed securely via Stripe), and by bank transfer. For bank transfer payments, a proforma invoice will be issued containing payment details. Full payment must be received within 14 days of the invoice date unless otherwise agreed in writing. Artworks will not be released or shipped until cleared funds have been received. We are unable to accept cash or cheque payments for online transactions.
12. Title and risk
Legal title to an artwork passes to the buyer only upon receipt of full cleared payment. Risk of loss or damage to the artwork passes to the buyer upon delivery to the buyer or their designated representative or carrier. Until title passes, the artwork remains the property of Bartha Contemporary Ltd.
13. Delivery
Delivery within the United Kingdom is provided free of charge unless otherwise stated. International delivery charges are confirmed separately prior to payment and are the sole responsibility of the buyer. All artworks are packed and shipped by specialist art handlers. Delivery timescales are estimates only and Bartha Contemporary Ltd. accepts no liability for delays caused by third-party carriers or customs processes. The buyer is responsible for ensuring someone is available to receive the delivery. Artworks should be inspected at the point of delivery; any visible damage should be noted on the carrier's delivery documentation and reported to us within 48 hours of receipt.
14. Authenticity, condition and description
Bartha Contemporary Ltd. takes reasonable care to ensure that descriptions and images of artworks on the Website are accurate. All artworks are sold as described and as shown. Condition reports are available on request prior to purchase. Minor variations in colour between images and the physical artwork may occur due to photographic and screen calibration differences. Works are sold in the condition described; any framing or packaging shown is indicative only unless expressly stated as included in the sale.
15. Cancellation and returns
As artworks are unique items of cultural and artistic value, and subject to the bespoke nature of art sales and specialist handling, the statutory 14-day cooling-off period that applies to standard distance selling contracts does not apply to purchases of artworks from Bartha Contemporary Ltd., in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, which exempt goods made to the consumer's specifications or clearly personalised. Once payment is received and a contract is formed, the sale is final unless the artwork is found to be materially different from its description, in which case please contact us at info@barthacontemporary.com within 48 hours of receipt.
16. Anti-money laundering
All purchases are subject to our Anti-Money Laundering (AML) obligations. For transactions at or above 10,000 EUR (or equivalent), we are required by law to verify the identity of the buyer. By making a purchase, you agree to provide such documentation as we reasonably request to fulfil our AML obligations. A full copy of our AML Statement is available at barthacontemporary.com/aml.
17. Intellectual property in artworks
The purchase of an artwork does not transfer any intellectual property rights, including copyright, in the work to the buyer. Copyright remains with the artist unless expressly stated otherwise in writing. The buyer may not reproduce, publish, or use images of the artwork for commercial purposes without the prior written consent of the copyright holder.
18. Governing law and disputes
These purchase terms, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the law of England and Wales. The parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim.
